M.A.R.F., candidate for Regional Councilor for Cordillera in the 2024 elections, filed a reclamation against Resolution N°G14814 of the Electoral Service, which approved his general account of electoral income and expenses with 18 observations. The candidate requested that the resolution be annulled, the account approved without observations, and a reimbursement of $8,898,323 be granted. The court analyzed each observation and found that some were subsanated because the candidate provided the required documentation, such as a donation certificate for a vehicle. However, many observations were maintained due to lack of justification or missing reports, including failure to provide activity reports and market value justifications for services. The court partially granted the reclamation, only to the extent of considering observations 3,4,5,6,7,9,18.1, and 18.2 as subsanated, but denied the reimbursement request because the expenses were not justified in accordance with Law N°19,884. The court emphasized the principle of sincerity of electoral accounts and the need to prevent illegal financing of politics.
