Hilda Soledad Gallardo Vásquez, candidate for councilor in Temuco, filed a reclamation against resolution N°G8751 of the Director of the Electoral Service, which approved with observations her general account of electoral income and expenses. The observation concerned a balance of $12,092 that had not been returned to the last contributor as required by Article 12 of Law N°19.884. The candidate did not respond to the observation notice but argued in her reclamation that the electoral bank account was blocked, preventing the return. The court verified from the audit report that the balance was indeed retained in the blocked account. The court considered that the impossibility to return the balance was due to causes beyond the candidate's will. Therefore, the court accepted the reclamation, considered the observation as remedied, and ordered the Electoral Service to authorize the return of the balance to the last contributor.
