Gabriel Alejandro Riveras González filed a recurso de protección against the Ministry of Interior and the Subsecretaría del Interior for their omission in pronouncing on his nationality request. The court first dismissed the exception of incompetence raised by the Subsecretaría, as the plaintiff's domicile in Viña del Mar gave the court jurisdiction. On the merits, the court found that the nationality request was being processed according to the applicable regulations, and the authority had received the documents on August 19 of the current year. The court considered that there was no excessive delay in the processing, so the omission could not be considered arbitrary or illegal. Therefore, the court rejected the protection writ without costs. The decision included a dissenting opinion from Abogado Integrante Verónica Munilla Espinoza, who would have accepted the writ based on the principles of unity and coordination of the State administration.
