Carlos Rafael Torres Alaña filed a recurso de protección against ENEL Distribución Chile S.A. for repeatedly cutting off his electricity despite a payment agreement. He claimed that after making a partial payment of $84,000, Enel suspended service multiple times, affecting his disabled father who requires electricity for medical needs. The plaintiff argued violations of his rights to life and property under Article 19 N°1 and N°24 of the Constitution. The court noted that the matter was under administrative investigation by the Superintendencia de Electricidad y Combustibles (SEC). The court held that since the dispute is pending before the specialized administrative authority, the plaintiff's right is not indubitable. Therefore, the court rejected the protection action, finding it cannot interfere with the ongoing administrative process.
